1. Introduction and acceptance

These Terms & Conditions ("Terms") govern your access to and use of nepkart.in (the "Website") and any purchase you make through it. The Website is owned and operated by Nepkart Ecommerce Private Limited ("Nepkart", "we", "us" or "our"), a company incorporated in India with its registered place of business at Paschim Nischintapur, Boral, Majher Para, South 24 Parganas, West Bengal — 700154, India.

These Terms constitute an electronic record under the Information Technology Act, 2000 and the rules made thereunder. They do not require any physical or digital signature.

By browsing the Website or placing an order, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, Return Policy and Refund Policy, each of which is incorporated into these Terms by reference. If you do not agree with any part of these Terms, please do not use the Website.

2. Eligibility

The Website is intended for users who are 18 years of age or older and capable of entering into a legally binding contract under the Indian Contract Act, 1872.

If you are under 18, you may use the Website only with the involvement and consent of a parent or legal guardian, in which case the parent or guardian is treated as the contracting party and is responsible for the transaction.

By placing an order, you represent that the information you provide — your name, contact details and delivery address — is true, accurate and complete, and that you are authorised to use the payment method you select.

3. Products, descriptions and availability

We sell sarees, kurtis, lehengas, salwar suits, blouses and other apparel and accessories. We make every effort to describe and photograph our products accurately. However:

  • Colours may vary. The colour you see depends on your screen's display settings and lighting in the photographs. Minor variation between the image and the delivered product is not a defect.
  • Handcrafted variation is natural. Many of our products are handwoven or hand-finished. Small irregularities in weave, print, zari or embroidery are characteristic of handcrafted goods and are not defects.
  • Measurements are approximate. Lengths, widths and garment measurements may vary slightly from those listed, within tolerances customary for the trade.

All products are subject to availability. Display of a product on the Website does not guarantee that it is in stock. We may withdraw, modify or limit quantities of any product at any time without notice.

4. Pricing and errors

All prices on the Website are in Indian Rupees (₹) and are inclusive of all applicable taxes, unless expressly stated otherwise. Shipping charges, where applicable, are shown separately in the cart and at checkout before you pay — see our Shipping Policy.

We may revise prices at any time without prior notice. The price applicable to your order is the price displayed at the time you place it; later price changes do not affect orders already confirmed.

Pricing and listing errors

Despite our best efforts, a product may occasionally be listed at an incorrect price or with incorrect information. If the correct price is higher than that stated, we may contact you for instructions or cancel the order and refund you in full. We are not obliged to supply a product at a manifestly incorrect price, even after an order confirmation has been sent.

5. Orders, acceptance and cancellation

Your order is an offer to buy. Our acknowledgement email or message confirms receipt of the order, not its acceptance. A contract for sale comes into existence only when the order is dispatched from our facility.

a. Cancellation by you

  • You may cancel an order free of charge at any time before it is dispatched by contacting us by email, phone or WhatsApp with your order number.
  • Prepaid orders cancelled before dispatch are refunded in full, including shipping, per our Refund Policy.
  • Once an order has been dispatched it can no longer be cancelled, but you may be able to return it under our Return Policy.
  • Made-to-order and customised items — such as stitched blouses, saree falls and pico work — cannot be cancelled once work has begun.

b. Cancellation or refusal by us

We reserve the right to refuse or cancel any order — for example where the item is out of stock, the address is not serviceable, a pricing or listing error is found, the order appears fraudulent or placed by a reseller or bot, or a bulk order exceeds retail quantities. Where a paid order is cancelled by us, you receive a full refund including shipping, initiated within 24 to 48 hours.

We may also disable Cash on Delivery for a customer who repeatedly refuses delivery of COD orders without cause.

6. Payments

You may pay by UPI, credit or debit card, net banking or wallet through Cashfree Payments, a payment aggregator authorised by the Reserve Bank of India, or by Cash on Delivery where available for your PIN code and order value.

We never see or store your payment credentials.

Card numbers, CVV, UPI PINs and net-banking credentials are entered directly on the payment gateway's PCI-DSS compliant systems. See section 5 of our Privacy Policy.

  • Your order is processed only after the payment gateway confirms a successful payment (or, for COD, after the order is verified).
  • If money is debited but the order is not confirmed, the amount is normally auto-reversed by your bank within 5 to 7 working days. If it is not, contact us with the transaction reference and we will take it up with the gateway.
  • For COD orders, please pay the exact invoice amount in cash to the delivery agent. No additional COD handling fee is charged by us.

7. Shipping and delivery

We ship across India at a flat ₹99 per order, free on orders of ₹999 and above (calculated on the subtotal after discounts). Orders are normally dispatched within 1–2 working days and delivered within 3 to 10 working days depending on your location. Delivery timelines are good-faith estimates, not guaranteed dates.

Risk in the products passes to you on delivery at the address you provided. Please ensure your address and phone number are accurate — we are not responsible for delay or non-delivery caused by an incorrect or incomplete address. 8. Returns, exchanges and refunds

Most items can be returned or exchanged within 7 days of delivery, provided they are unused, unwashed, unaltered and carry their original tags and packaging. Certain categories — notably innerwear and nightwear — are non-returnable for hygiene reasons, and damaged or wrong items should be reported within 48 hours of delivery.

Approved refunds are initiated within 2 working days of the quality check and typically reach you within 5 to 7 working days thereafter. The complete rules, conditions and timelines are set out in our Return Policy and Refund Policy, which form part of these Terms.

9. Offers and discount codes

  • Promotional offers, discount codes and sale prices are valid only for the period, products and conditions stated, and may be modified or withdrawn at any time without notice.
  • Unless stated otherwise, one discount code applies per order and codes cannot be combined, exchanged for cash, or applied retrospectively to orders already placed.
  • If an item bought with a discount is partially returned, the discount is apportioned by item value as described in our Refund Policy.
  • We may cancel orders that abuse an offer — for example through multiple accounts, automated ordering or reselling.

10. Acceptable use of the website

You agree to use the Website only for lawful, personal, non-commercial shopping purposes. In particular, you must not:

  • Provide false, misleading or impersonated identity, contact or payment information;
  • Use any robot, scraper, crawler or other automated means to access the Website, or copy its catalogue, prices or content for commercial use;
  • Attempt to gain unauthorised access to the Website, its servers, or any connected system, or probe, scan or test their vulnerability;
  • Introduce viruses or other malicious code, or take any action that imposes an unreasonable load on our infrastructure;
  • Place orders you do not intend to honour, including repeated refusal of COD deliveries;
  • Use the Website in any way that violates applicable law, including the Information Technology Act, 2000.

We may suspend or block access to the Website, and refuse future orders, for any breach of this section.

11. Intellectual property

All content on the Website — including the Nepkart name and logo, product photographs, designs, text, graphics, page layouts and code — is owned by or licensed to Nepkart Ecommerce Private Limited and is protected under Indian copyright, trademark and other intellectual property laws.

You may view, download and print pages for your own personal, non-commercial use. Any other reproduction, modification, distribution, republication or commercial exploitation of Website content without our prior written consent is prohibited.

Nothing in these Terms grants you any licence or right to use any trademark, logo or brand name displayed on the Website.

12. Reviews and feedback

If you submit a review, photograph, testimonial, suggestion or other content to us — on the Website, by email or on our social media pages — you confirm that it is your own, that it is genuine and based on your experience, and that it does not infringe anyone else's rights or contain unlawful, defamatory or obscene material.

You grant us a non-exclusive, royalty-free, perpetual licence to use, reproduce, adapt and display such content in connection with our business, including on the Website and in our marketing, with or without your name. We may moderate, edit for length, or remove content at our discretion.

13. Disclaimers and limitation of liability

The Website and its content are provided on an "as is" and "as available" basis. While we work to keep the Website accurate, secure and available, we do not warrant that it will be uninterrupted, error-free or free of harmful components, or that defects will always be corrected.

To the maximum extent permitted by applicable law:

  • Our total aggregate liability arising out of or in connection with any order is limited to the amount you actually paid for that order;
  • We are not liable for any indirect, incidental, special or consequential loss — including loss of profit, data or goodwill — even if advised of the possibility of such loss;
  • We are not liable for delays or failures caused by couriers, payment gateways, banks or other third parties beyond our reasonable control, though we will assist you in resolving such issues.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under Indian law, or affects your statutory rights as a consumer under the Consumer Protection Act, 2019.

14. Indemnity and force majeure

a. Indemnity

You agree to indemnify and hold harmless Nepkart Ecommerce Private Limited, its directors and employees from any claim, loss, damage or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Website, or your violation of any law or the rights of a third party.

b. Force majeure

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control — including natural disasters, floods, epidemics, strikes, bandhs, riots, war, fire, power or internet outages, courier network disruptions, or acts of government. Affected timelines are extended for the duration of the event, and we will keep you informed where your order is impacted.

15. Governing law and disputes

These Terms, and any order placed under them, are governed by and construed in accordance with the laws of India.

Subject to any mandatory consumer-protection provisions that give you the right to approach a consumer forum where you reside, the courts at Kolkata, West Bengal shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Website.

Before initiating any formal proceedings, we encourage you to write to our Grievance Officer (section 17) — most issues are resolved quickly once we can see the order history and correspondence.

16. General provisions and changes to these terms

  • Entire agreement — these Terms, together with the policies incorporated by reference, constitute the entire agreement between you and us regarding the Website and supersede any prior understanding.
  • Severability — if any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.
  • No waiver — our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Assignment — you may not assign your rights under these Terms; we may assign ours to a successor entity in connection with a merger, acquisition or sale of assets.

We may update these Terms from time to time to reflect changes in our practices, offerings or legal requirements. The revised version will be posted on this page with a new "Last updated" date. Where the changes are significant, we will take reasonable steps to notify you. Your continued use of the Website after the changes take effect constitutes acceptance of the revised Terms.

17. Grievance officer and contact

In accordance with the Information Technology Act, 2000, the Consumer Protection (E-Commerce) Rules, 2020 and the rules made thereunder, the contact details of the Grievance Officer are set out below. We aim to acknowledge every grievance within 48 hours and resolve it within 30 days.
